These Terms and Conditions ("Terms") govern your use of the Bename mobile application and this website. Bename is operated by Robert Temple ("Developer," "we," "us," or "our"). By downloading, installing, or using Bename, you agree to these Terms.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Bename for personal, non-commercial purposes, subject to these Terms and the Apple Media Services Terms and Conditions.

Your responsibilities

You are responsible for the information you enter into Bename, including names, notes, and location tags. You agree not to use the app for any unlawful purpose or to store information you do not have the right to record.

You are responsible for maintaining the security of your device and any backups of your data.

Location services

Certain features require location permissions. By enabling location access, you authorize Bename to use your device's location to provide place-based reminders and related functionality. You may disable location access at any time in your device Settings, though some features may not work without it.

Premium purchases

Bename may offer optional in-app purchases, such as Bename Premium. All purchases are processed by Apple through the App Store. Pricing, billing, refunds, and subscription or purchase management are handled in accordance with Apple's terms and policies. We do not provide refunds directly; refund requests must be submitted to Apple.

Intellectual property

Bename, including its name, logo, design, and software, is owned by the Developer and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as needed to use the app as intended.

Disclaimer of warranties

Bename is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the app will be error-free, uninterrupted, or that it will always correctly remind you of names or locations. You use Bename at your own risk.

Limitation of liability

To the fullest extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising from your use of Bename. Our total liability for any claim related to the app shall not exceed the amount you paid for Bename Premium in the twelve months preceding the claim, or ten U.S. dollars if you have not made any purchase.

Termination

You may stop using Bename at any time by uninstalling the app. We may suspend or discontinue the app or any feature at any time without notice.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when they were last revised. Continued use of Bename after changes constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the United States and the State in which the Developer resides, without regard to conflict-of-law principles.
